Averionyx Marketing ("we," "us," or "our") operates averionyxmarketing.com (the "Site"). This policy explains what personal information we collect, why we collect it, how we use it, and the rights you have over it.

Information We Collect

We collect the information you provide directly — such as your name, email, phone number, business name, and answers to our qualification form — when you fill out a form, email us, or schedule a call. Third-party services embedded on the Site (such as our scheduling tool and video player) may set their own cookies and collect standard technical data (like IP address and browser type) under their own privacy policies. We also run analytics on the Site: Google Analytics 4 measures how pages are used, and Microsoft Clarity records anonymized session activity such as clicks, scrolling, and mouse movement so we can see where the Site is confusing. Our ad landing pages (/winter and /sms-opt-in) also use the Meta Pixel, described under Cookies below, and TrustedForm, which records your visit to the form page, including the consent language shown, so we can document that you gave consent. We do not use analytics data to build advertising profiles.

How We Use Your Information

Text Messages (SMS)

We send text messages only to people who have given us permission to do so. We collect consent in one of two ways. On our website forms, you can tick an optional checkbox that states our name, that message frequency varies, that message and data rates may apply, and that you can reply STOP to unsubscribe or HELP for help. On a phone call, our representative asks whether you would like information by text and tells you the same things. For website consent we record the date, time, page, and consent language shown; for phone consent, the date, time, number, and the representative who collected it. We do not text numbers that have not given us that permission, and we do not text numbers obtained from purchased, rented, or third-party lead lists.

The messages we send contain information you asked for during the call, confirmations for meetings you booked, and follow-ups on those meetings. You can stop them at any time by replying STOP, and you can reply HELP to reach us.

Mobile phone numbers collected for text messaging are never sold, rented, or shared with third parties or affiliates for their own marketing purposes. We share them only with the messaging providers that deliver our texts on our behalf, and only for that purpose. Consent to receive text messages is not a condition of purchasing anything from us.

Legal Basis for Processing (EEA / UK visitors)

If you are located in the European Economic Area or the United Kingdom, we process your personal data under one or more of the following legal bases under the GDPR / UK GDPR: (a) your consent, (b) performance of a contract or steps taken at your request before entering a contract, (c) our legitimate business interests in responding to inquiries and running our business, and (d) compliance with a legal obligation.

Third-Party Services

We use third-party services to run this Site and follow up with you: Calendly (appointment scheduling), GoHighLevel / LeadConnector (customer records, lead notifications, and text messaging), TrustedForm by ActiveProspect (consent records on our form pages), Meta (the Meta Pixel on our ad landing pages), Brevo (form processing and email on some pages), YouTube (video playback — served via youtube-nocookie.com where we control the embed), Google Fonts (typography), Google Analytics 4 (site usage measurement), and Microsoft Clarity (session recording and heatmaps). Each service has its own privacy policy governing how it handles data. We do not control and are not responsible for the practices of these providers.

Cookies and Similar Technologies

Google Analytics 4 and Microsoft Clarity set first-party cookies to recognize returning visits and group page views into sessions. On our ad landing pages we use the Meta Pixel. It sets cookies and tells Meta when someone views the page or submits the form, so we can measure our Facebook and Instagram ads and show them to people likely to be interested. It does not send Meta the name, phone number, or email you type into our forms. You can limit this in your Facebook or Instagram ad settings, in your browser's cookie settings, or at optout.aboutads.info. The other third-party services embedded on the Site (listed above) may set their own cookies when their functionality loads. These are typically limited to what is necessary to run those services. If you access the Site from the EEA, UK, or another jurisdiction requiring cookie consent, you can manage third-party cookies through your browser settings or by declining to use the embedded features (for example, by not opening the scheduling tool). We do not currently deploy a first-party cookie consent banner — this is on our roadmap.

Data Sharing

We do not sell or rent your personal information. We share data only with the service providers listed above, as necessary to operate our business, and with legal or regulatory authorities where required by law.

Data Security

We protect the information you give us with measures appropriate to its sensitivity. The Site is served over HTTPS, so information submitted through it is encrypted in transit. Access to contact records is limited to the people who need it to do the work, which today means James Sanford. The third-party services listed above store data on their own systems under their own security programs and privacy policies. No method of transmission or storage is completely secure, and we do not claim ours is. If you believe your information has been compromised, email us and we will investigate and tell you what we find.

Data Retention

We retain your personal information only for as long as needed to fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law (for example, for tax or dispute-resolution purposes).

Your Rights

All visitors: You may request to access, correct, or delete your personal information at any time by emailing us.

EEA / UK residents (GDPR / UK GDPR): You have the right to access, rectify, erase, restrict processing of, port, and object to processing of your personal data, and the right to withdraw consent where processing is based on consent. You also have the right to lodge a complaint with your local data protection authority.

California residents (CCPA / CPRA): You have the right to know what personal information we collect, use, disclose, and (where applicable) sell or share; the right to delete your personal information; the right to correct inaccurate personal information; and the right to opt out of the sale or sharing of personal information. We do not sell personal information. The Meta Pixel on our ad landing pages may count as "sharing" for advertising under some state laws. To opt out, email us or use the options in the Cookies section. You will not be discriminated against for exercising these rights.

Other US state residents (VA, CO, CT, UT, and others with comprehensive privacy laws): You may have similar rights to those described above. Contact us to exercise them.

How to Exercise Your Rights

To exercise any of the rights above, or to request deletion of your data, email us at averionyxmarketing@gmail.com with your request and enough information for us to identify you. We will respond within the timeframe required by applicable law.

International Data Transfers

Averionyx Marketing operates in the United States. If you are outside the US and contact us or use the Site, your information will be transferred to and processed in the United States, which may have different data protection laws than your country. By using the Site, you consent to that transfer.

Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have collected such information, please contact us and we will delete it.

Changes to This Policy

We may update this policy from time to time. When we do, we'll change the "Last updated" date above.
